Virginia’s Move Over Law – Give Them Space, Save a Life

When you see flashing lights ahead—whether it’s red, blue, amber, or even just hazard lights—Virginia law says it’s time to take action.

If a vehicle is stopped on the side of a highway with:

  • Flashing emergency lights

  • Hazard lights on

  • Caution signs, flares, or strobes

…you must either Move Over or Slow Down.

Here’s what that means under Virginia Code § 46.2-861.1:

Move Over: If it’s safe to do so, change lanes to one that’s not directly next to the stopped vehicle.

Slow Down: If a lane change isn’t safe, slow down and pass with caution—adjusting your speed to match road and traffic conditions.

Important Note:
The law applies on highways with at least four lanes (two going in your direction).

This law does NOT apply in highway work zones—those have their own safety rules.
